Terms of Service
Effective July 22, 2026
These Terms of Service (these “Terms”) are between you and Hunter Pollock, doing business as “Perch” (“Perch,” “we,” “us”), and govern your use of the perchapp.org websites, documentation, statistics and telemetry services, and any other online services we operate (the “Services”). The Perch™ desktop application itself is licensed under the End User License Agreement. By using the Services you agree to these Terms and the Privacy Policy.
1. The Services
The Services include the perchapp.org website, the documentation at perchapp.org/docs, redirect and convenience subdomains, and the backend services that receive the App’s anonymous telemetry and serve aggregate statistics. We may change, suspend, or discontinue any part of the Services at any time without liability.
2. Acceptable use
You agree not to:
- probe, disrupt, overload, or attempt to gain unauthorized access to the Services or their infrastructure;
- send fabricated, automated, or manipulated data to our telemetry or statistics endpoints, or attempt to pollute or scrape aggregate statistics;
- misrepresent affiliation with Perch, or use the Perch™ name, logo, or branding in a way likely to confuse (fan projects and mods may reference Perch factually — “made for Perch” — but may not present themselves as official);
- use the Services to violate applicable law or others’ rights.
3. Intellectual property
The Services and their content — including the Perch™ name and logo, the website, and the documentation — are owned by us or our licensors. The documentation is meant to be used: you may read, quote, and follow it to build mods and use the App, including in commercial mods. Republishing the documentation wholesale, or using our branding as your own, is not permitted without written permission.
4. Community spaces
Our community spaces (such as the Discord server and Steam Workshop pages) are hosted on third-party platforms and governed by those platforms’ terms in addition to reasonable moderation by us. We may moderate, restrict, or ban participation in our spaces at our discretion.
5. Third-party links and services
The Services link to third-party sites and services (Steam, Discord, social platforms). We are not responsible for their content, terms, or privacy practices.
6. Disclaimer of warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DOCUMENTATION IS FREE OF INACCURACIES.
7. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING FROM OR RELATED TO THE SERVICES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICES WILL NOT EXCEED FIFTY US DOLLARS (US $50) OR, IF GREATER, THE AMOUNT YOU PAID US FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
8. Changes to these Terms
We may update these Terms by posting the revised version on this page with a new effective date. Continued use of the Services after changes take effect constitutes acceptance.
9. Governing law
These Terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to conflict-of-law rules. Exclusive venue for disputes is the state and federal courts located in Massachusetts, and each party consents to their jurisdiction.
